The assumption that we attorneys have worked on for so long that as person who is applying for adjustment of status is in a legal status in the U.S. even if his nonimmigrant status expires, never 100% technically correct to begin with, is being eroded day by day. One should work on the assumption that any DHS officer who confronts a client after their nonimmigrant status expires will treatment them as out of status and subject to detention. Actually, in this story Mr. Shusterman's clients got lucky because DHS decided to equate having employment authorization with having a legal status in the U.S. There is no law requiring them to do so and it would not surprise me that the next time a similar story is distributed DHS doesn't even agree that having an EAD makes one legal.

Well, it's a good thing when CBP is being so efficient and vigorous with such dangerous people. It would be different, of course, if your clients were people we really needed in the USA, like registered nurses.

Mr. Piston, your post makes little sense. If an alien with an AOS application pending has an EAD, which by definition authorizes that alien to work in the United States (and presumably, to LIVE in the United States), how is that person subject to detention? Having an EAD does not confer "legal status" on an alien, as you mention in your post-- it merely AUTHORIZES that alien to legally accept employment in the U.S. I think perhaps you are confusing the situation when an alien has an approved I-130 but no AOS pending. In this latter situation, the alien would have no EAD and thus would be subject to detention and removal.
